An American woman is suing a county official because she believes she been denied a marriage licence because her fiance is an illegal immigrant, The Times Tribune reports

An American woman is suing a county official because she believes she been denied a marriage licence because her fiance is an illegal immigrant, The Times Tribune reports.

Heather Buck, from West Hazleton, Pennsylvania, has filed a law suit against the county official who has prevented her from wedding her Mexican partner Jose Arias-Maravilla.

The law suit has been filed against county Register of Wills Dottie Stankovic. Ms Buck claims that Ms Stankovic refused the licence on the grounds that Mr Arias-Maravilla could not provide enough identification, despite having enough documentation including forms ordering his deportation back to Mexico.

She is being represented by the American Civil Liberties Union (ACLU), who have argued that by disallowing Ms Buck from marrying who she wants, despite his illegal immigrant status, is a violation of her Constitutional rights.

Witold J Walczak, an ACLU attorney, said: "It has nothing to do with identification. It has everything to do with immigration status."

The couple, who have a young son together, want to get married before Mr Arias-Maravilla is forced to return to Mexico in May.
