A couple from New York embroiled in a bitter divorce have come to fresh blows after the husband has accused his soon to be ex-wife of "judge shopping".

Shana Taub filed for divorce against her estranged partner Simon in 2005 through a court in Brooklyn, the New York Post reports.

However, Mrs Taub has since filed a new case through a court in Manhattan after her claims of cruelty and adultery were rejected in the original case, leaving the pair still married.

The second case has been filed in Manhattan because Mrs Taub's lawyers believe she will not receive "a fair trial in Brooklyn" because of her Jewish faith.

Moreover, her lawyer Irvin Rosenthal claims that Mr Taub has continued to be unfaithful since the original case was tried in 2005. Mr Rosenthal said: "He's committed acts of cruelty and adultery since [the first case was filed]."

The couple's original divorce was nicknamed "the War of the Roses" after the presiding judge told Mr and Mrs Taub that they should use a temporary wall to separate their home into two individual living quarters.
